Trial Win for Equipment Manufacturer in Products Liability Case

Barclay Damon was retained as local trial counsel by an international manufacturer of forklifts and heavy equipment to defend it in a products liability claim venued in the Federal District Court for the Northern District of New York. The plaintiff fell 15 feet from a “cherry picker” while stacking boxes in his employer's warehouse and he sustained severe injuries, including two fractured ankles and a compound comminuted fracture of his femur. The plaintiff alleged that the cherry picker was defectively designed causing him to fall from the platform. After a one week trial, the jury found that the cherry picker was not defectively designed and returned a verdict in favor of our client.
